This Rental Agreement applies whenever a New York sole proprietorship, doing business as Deep Space Family Games (referred to as "we", "us", or "our"), rents a game to you (referred to as "you" or "the renter"). It applies alongside our Terms and Conditions and Privacy Policy. Confirming a reservation with us — in writing by email, or by phone — means you agree to the terms below.
Who Can Rent
Whoever confirms the reservation needs to be 18 or older, and we'll ask for a photo ID at handover to match the name on the confirmation. It's a small ask, and the reason is straightforward — there needs to be one adult responsible for a game, start to finish.
What We Rent
We rent board games, mostly — plus card games, dice games, and a small number of puzzles. Every rental is for a specific, named title, agreed with you when we confirm your request. We do not run live availability or instant booking: a request through our reservation form is exactly that, a request, and nothing is held for you until we write back and confirm it.
Small Parts and Supervision
Many of the games we rent include small pieces — dice, meeples, tokens, tiny cards — that are a choking hazard for young children. Check the age and choking-hazard warning on the box before a game comes out around toddlers or younger siblings, and keep loose pieces out of reach when they're not part of the play. Once a game is in your home, keeping it away from kids too young for the pieces is on you.
How Checkout Works
Every game goes out checked against a contents list — every piece, card, and booklet it's supposed to have — and comes back checked against that same list. You're welcome to check the contents yourself at handover; we'd rather you catch something at the door than discover it mid-game. If a piece turns out to be missing once you're playing, tell us — it matters more to us that we know than how it happened.
Rental Period
Out after 10am, back before 10am the next day. Pickup and drop-off are by appointment, both ways. The exact dates, and whether your rental runs a single night, a weekend, or longer, are confirmed in writing when we reply to your request — never assumed from what you originally asked for.
Deposit
We don't currently charge a deposit on a rental. If that changes for a specific rental, you'll see it in writing before you agree to anything — the same as every other figure we confirm.
Sales Tax
New York sales tax applies to the rental and, where you choose delivery, to the delivery fee as well — delivery is taxed the same way the rental it's attached to is taxed. No rate is published here; the exact amount is calculated on your actual total and confirmed in writing when we reply to your request.
Delivery and Pickup
We deliver within a limited local radius of Plattekill, NY, or you can arrange local pickup and drop-off instead — both by appointment, in both directions. We don't operate a walk-in location and don't publish an address; a pickup or drop-off time and place is something we agree with you directly. Delivery is not available outside our stated radius, and this Agreement does not cover shipping — we don't offer it.
Because handover only happens in person, we're counting on someone being there at the agreed time. If nobody's available when we arrive, we'll reach out to reschedule — the next attempt goes out as its own trip, at our standard delivery rate, the same as the first one.
Tips aren't expected, but they're welcome. Cash at handover works, or we'll point you to a digital option when we confirm your request.
Returning a Game
Wear from being played is expected — that's what the games are for, and it isn't charged for. Two things are:
- Late returns. A late fee applies when a game comes back after the agreed return time. It isn't a penalty for its own sake — someone else is usually waiting on that same copy, and a game on your table past the agreed time is a game that isn't on theirs. If you know you're running over, tell us before the return time; we'll usually extend it.
- Returned not put away. Every game should come back packed the way it went out — pieces in their bags, cards in the deck, everything back in the box. A game returned tipped in loose (not sorted back into place) carries a fee for the time it takes us to sort it out before the next rental.
Neither fee has a published amount here — both are confirmed in writing when we reply to your request, and invoiced directly if either ends up applying. Puzzles are additionally piece-counted before they go back out to the next renter.
If a game stays out well past the agreed return date — more than 14 days, with no word from you — we stop treating it as late and start treating it as lost, the same way an unreplaceable piece is treated below under Damage and Loss: we'll invoice you directly for the replacement cost, worked out and confirmed with you in writing — no amount is posted here. It isn't a threat, it's what it actually takes to get a copy replaced and back in rotation for whoever's waiting on it next. If something's come up, tell us — we'd much rather sort it out than get here.
Damage and Loss
Tell us what happened as soon as you notice it — that matters to us more than how it happened. A missing piece is often replaceable, and we'll usually just handle it. Damage that ends a game's usable life — or a piece we can't replace — is billed to you directly at replacement cost; we'll walk you through it rather than surprise you with it after the fact.
Prohibited Uses
A rented game is yours to play, not to keep, sell, sublet, or take apart. Don't sell it, lend it to anyone outside your household for the rental period, swap its pieces with another copy, or use it for anything illegal. A copy that comes back with mismatched pieces, or shows signs it was used for something other than playing it as intended, is treated the same as damage or loss above.
Liability
Once a game is in your hands, how it gets used is on you. We're not responsible for injury or property damage that happens while a rented game is being played, and by renting from us you agree to cover any claim brought against us that comes out of your own use of the game — the ordinary kind of risk that comes with having people over to play something, not anything we did.
Try It Before You Buy It
Rent it before you commit to buying it — if you decide you want to keep a game you rented, the fee from that rental credits toward buying that exact copy from us, in person, as long as you do it within 30 days of returning it. Just mention it when you reach out; every sale goes through us directly, so there's no separate system to check it against.
Cancellations
Because every rental starts as a request and is only confirmed once we write back, you can cancel a pending request at any time before we confirm it, at no cost. If you need to cancel a rental we've already confirmed, tell us as soon as you can — reach out through our contact page and we'll sort out the details directly; there is no online cancellation flow.
Governing Law and Venue
This Rental Agreement is governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising out of or relating to this Agreement or a rental made under it shall be resolved in the state or federal courts located in Ulster County, New York, and by confirming a rental you consent to the personal jurisdiction of those courts.
Changes to This Agreement
We may update or revise this Rental Agreement at any time. Material changes will be reflected in the "Last revised" date at the top of this page; the terms confirmed with you at the time of your reservation are the ones that apply to that rental.
